By enrolling as an affiliate of Aqua Health Products Inc., you agree to comply with the terms and conditions outlined in this agreement.
This Agreement sets forth the complete terms and conditions of your participation in the Aqua Health Products Affiliate Program. The purpose of the program is to enable approved affiliates to promote Aqua Health Products via HTML links and marketing materials and to earn referral commissions through qualified purchases made via your affiliate links.
Throughout this Agreement, “we,” “us,” and “our” refer to Aqua Health Products Inc., and “you,” “your,” and “yours” refer to the affiliate.
2.1 To apply, complete the online application at https://aquahealthproducts.com/affiliate-registration-portal/. Applications are manually reviewed, and we reserve the right to accept or reject any applicant at our sole discretion, without obligation to provide justification.
2.2 Each affiliate is permitted one account only. Self-referrals and purchases made using your own affiliate links are strictly prohibited.
2.3 Affiliates may not replicate, imitate, or design websites that closely resemble any of our websites, including but not limited to aquahealthproducts.com, produitsaquasante.com, mayu.ca, aquaberkeyfilters.ca. This includes, among others, using domain names that are misspellings or variations of our brand, which could mislead customers.
2.4 Once accepted, you will have access to your affiliate dashboard at https://aquahealthproducts.com/affiliate-dashboard/, where you can find your unique affiliate link, banners, tracking tools, and coupon codes.
2.5 To accurately track visits and purchases, you must use your unique affiliate link or the HTML code provided. You must ensure that all affiliate links are properly formatted with your unique ID. It is your responsibility to verify the correct implementation of links on your site, social channels, emails, or other marketing platforms.
2.6 Affiliates are solely responsible for ensuring their content complies with all applicable intellectual property laws on their website, social media channels, emails, … and any channel they choose to share their content. You must have the rights and express permission to use any and all content you publish, including any person’s copyrighted material, whether it be a written piece, an image, or any other copyrightable work. We will not be responsible (and you will be solely responsible) if you use another person’s copyrighted material or other intellectual property in violation of the law or any third party rights.
2.7 Affiliates may not post offensive, defamatory, illegal, or misleading content. We reserve the right to remove any affiliate found to be promoting harmful, inappropriate material, or material that does not align with our values.
2.8 Sharing any content about our products and websites that is not included in the Affiliates’ library should be previously approved by us.
2.9 You must maintain a valid Canadian physical address to participate in the program. If you relocate outside of Canada, your affiliate account may be terminated.
3.1 We reserve the right to review and monitor your affiliate channels to ensure compliance. We may request changes to your materials or practices. Non-compliance may lead to termination.
3.2 Fraudulent or abusive practices, including misrepresentation, spam marketing, or self-referrals will result in immediate termination of your account without prior notice and forfeiture of all unpaid commissions.
We may revise these terms at any time. Updates will be communicated via email. Continued participation in the program implies acceptance of the revised terms.
This Agreement shall begin from the time of our acceptance of your affiliate application and shall end when terminated by either party. Either party may terminate this Agreement at any time, with or without cause, by giving the other party written notice of termination. If the Agreement is terminated by an affiliate in good standing, commissions will be paid out for sales generated by your affiliate link, up until the date of termination notification, even if the balance owed is less than CAD $50. Affiliates found in non-compliance with the membership and affiliate Terms & Conditions will be immediately terminated without notice. If the termination is due to non-compliance with the terms and conditions set out herewith, no outstanding commissions will be paid out to the affiliate. Upon the termination of this Agreement for any reason, you agree to immediately cease use of, and remove from your site all graphics, banners, logos, and all other marketing materials provided by or on behalf of us to you in connection with the Aqua Health Products Affiliate Program.
Commissions are calculated as a percentage of gross sales (excluding tax and shipping) made via your referral link.
Minimum payout is CAD $50.
We use AffiliateWP as our affiliate tracking software. This program allows us to determine the commissions earned for each affiliate.
Commissions are paid to affiliates as a percentage of the value of products sold to a lead that you referred to us through your personal affiliate link. The percentage may vary. Commissions are paid on gross sales, including discounts but excluding tax and shipping where applicable. Commissions are paid within 30 days for the prior month after your request if the sum of commissions exceeds the minimum transfer amount of CAD $50. We reserve the right to modify or amend the commission structure for any reason and at any time. Notifications of such changes, should they occur, will be sent to affiliates by e-mail. Your continued link to your affiliate site will be considered as acceptance of these changes. Money credited to Your Account does not accrue interest. In the event of a void order, we may recover from you the corresponding commission previously credited to your account. The void commission will be immediately deducted from your account balance. In the event that your account balance is less than the void commission, the void commission will be deducted against your future earnings.

Also, when you post to news groups that welcome commercial messages, you must clearly represent yourself and your web sites as independent from any Aqua Health Products website or associated brand. If it comes to our attention that you are spamming, we will consider that cause for immediate termination of this agreement and your participation in the Affiliate Program and any pending balances owed to you will not be paid.
Aqua Health Products makes no guarantees regarding uninterrupted website operation or error-free performance. We will not be liable for any damages resulting from system interruptions or technical issues.
All confidential information shared during the term of this agreement—including but not limited to business strategies, financial data, or customer details—must remain confidential and not be disclosed without written consent.
10.1 You agree that you are an independent contractor, and nothing in this Agreement will create any partnership, joint venture, agency, franchise, sales representative, or employment relationship between you and Aqua Health Products Inc. You will have no authority to make or accept any offers or representations on our behalf. You will not make any statement, whether on your website or otherwise, that reasonably would contradict anything in this Section.
10.2 This Agreement shall be governed by and interpreted in accordance with the laws of the province of Quebec, Canada.
10.3 You may not amend or waive any provision of this Agreement unless in writing and signed by both parties.
10.4 This document represents the full agreement between the parties, and shall supersede all prior agreements and communications of the parties, oral or written.
10.5 If any provision of this Agreement is held to be invalid or unenforceable, that provision shall be eliminated or limited to the minimum extent necessary such that the intent of the parties is effectuated, and the remainder of this agreement shall have full force and effect.

2.2 Un seul compte est autorisé par affilié. L’auto-référencement et les achats effectués via vos propres liens sont strictement interdits et peuvent entraîner la résiliation de votre compte.
2.3 Il est interdit de copier, imiter ou concevoir un site Web ressemblant à nos sites, y compris mais sans s’y limiter : aquahealthproducts.com, produitsaquasante.com, mayu.ca, aquaberkeyfilters.ca. Cela inclut l’utilisation de noms de domaine ressemblant à nos marques, y compris des variantes ou fautes d’orthographe pouvant induire les clients en erreur.

2.5 Pour assurer un suivi précis des visites et achats, vous devez utiliser votre lien affilié unique ou le code HTML fourni. Il est de votre responsabilité de vous assurer que les liens sont correctement intégrés et identifiés par votre identifiant unique.
2.6 Il est de votre entière responsabilité de respecter les lois en vigueur sur la propriété intellectuelle. Vous devez disposer des droits nécessaires pour publier tout contenu, incluant textes, images, ou toute œuvre protégée. Nous ne saurions être tenus responsables en cas de violation.
2.7 Il est interdit de publier du contenu offensant, diffamatoire, illégal ou trompeur. Nous nous réservons le droit de suspendre toute collaboration avec un affilié ne respectant pas ces valeurs.
2.8 Tout contenu à propos de nos produits ou sites Web qui n’est pas issu de la bibliothèque officielle des affiliés doit être préalablement approuvé par notre équipe afin d’assurer la cohérence des communications de marque.
2.9 Vous devez avoir une adresse physique valide au Canada pour participer au programme. Un déménagement à l’extérieur du Canada entraînera la résiliation de votre compte affilié.
3.1 Nous nous réservons le droit d’inspecter vos canaux promotionnels pour nous assurer de leur conformité. Nous pourrons demander des ajustements au besoin. Le non-respect peut entraîner la résiliation immédiate.
3.2 Toute pratique frauduleuse ou abusive, telle que le spam ou la fausse déclaration, entraînera la résiliation immédiate de votre compte et l’annulation des commissions impayées.
Nous pouvons modifier les présentes conditions à tout moment. Les mises à jour seront communiquées par courriel. Le maintien de votre participation au programme vaut acceptation des nouvelles conditions.
Cet accord prend effet à partir de l’approbation de votre candidature et demeure en vigueur jusqu’à sa résiliation par l’une ou l’autre des parties. Chaque partie peut mettre fin à cet accord à tout moment par un avis écrit.
En cas de résiliation par un affilié en règle, les commissions dues seront versées pour les ventes effectuées jusqu’à la date de résiliation, même si le solde est inférieur à 50 CAD.
En cas de non-respect des conditions, aucune commission ne sera versée, et la résiliation peut être immédiate.
Dès la résiliation, vous vous engagez à retirer immédiatement tout le matériel promotionnel associé à Aqua Health Products / Produits Aqua Santé.
Les commissions sont calculées en pourcentage des ventes brutes (excluant taxes et frais de livraison) réalisées par l’intermédiaire de votre lien.
Le seuil de paiement minimum est de 50 $ CAD.
Nous utilisons AffiliateWP comme logiciel de suivi. Les commissions sont versées dans les 30 jours suivant votre demande pour les ventes du mois précédent.
Le pourcentage peut varier. Les commissions sont basées sur les ventes brutes, incluant les rabais mais excluant les taxes et frais d’expédition.
Nous nous réservons le droit de modifier la structure de commissions à tout moment, avec avis envoyé par courriel. Votre utilisation continue du lien affilié constitue une acceptation.
Aucun intérêt ne s’applique sur les montants dus. En cas de commande annulée, la commission correspondante sera déduite de votre solde, ou des gains futurs.
Les formes suivantes de publicité sont strictement interdites :
– Envois de courriels non sollicités (spam)
– Publications sur des forums non commerciaux
– Dissimulations de votre identité ou domaine
Vous pouvez contacter vos clients existants si ceux-ci peuvent se désabonner facilement. Dans les groupes acceptant les messages commerciaux, vous devez clairement vous identifier comme indépendant de Aqua Health Products / Produits Aqua Santé.
En cas de pratique douteuse, nous résilierons immédiatement votre compte sans paiement des montants en attente.
Aqua Health Products / Produits Aqua Santé ne garantit pas un fonctionnement ininterrompu ou exempt d’erreurs de ses sites. Nous ne serons pas responsables des conséquences liées à toute interruption ou défaillance technique.
Toute information confidentielle partagée dans le cadre de cet accord (stratégies, données clients, données financières, etc.) doit rester strictement confidentielle et ne peut être divulguée.
10.1 Vous agissez en tant que travailleur autonome. Aucune relation d’emploi, agence ou partenariat n’est créée par cet accord.
10.2 Cet accord est régi par les lois de la province du Québec, Canada.
10.3 Aucune modification de votre part ne sera valide sans accord écrit des deux parties.
10.4 Cet accord constitue l’entente complète entre les parties et remplace tout accord antérieur, verbal ou écrit.
10.5 Si une clause est jugée invalide, elle sera ajustée au minimum nécessaire pour respecter l’intention des parties, et le reste de l’accord demeurera en vigueur.
