Chaque partie peut mettre fin \u00e0 cet accord \u00e0 tout moment par un avis \u00e9crit.<\/p><p>En cas de r\u00e9siliation par un affili\u00e9 en r\u00e8gle, les commissions dues seront vers\u00e9es pour les ventes effectu\u00e9es jusqu\u2019\u00e0 la date de r\u00e9siliation, m\u00eame si le solde est inf\u00e9rieur \u00e0 50 CAD.<\/p><p>En cas de non-respect des conditions, aucune commission ne sera vers\u00e9e, et la r\u00e9siliation peut \u00eatre imm\u00e9diate.<\/p><p>D\u00e8s la r\u00e9siliation, vous vous engagez \u00e0 retirer imm\u00e9diatement tout le mat\u00e9riel promotionnel associ\u00e9 \u00e0 Aqua Health Products \/ Produits Aqua Sant\u00e9.<\/p><h3>6. Avertissement<\/h3><p>Aqua Health Products \/ Produits Aqua Sant\u00e9 ne garantit pas un fonctionnement ininterrompu ou exempt d\u2019erreurs de ses sites. Overview<\/h3><p>By enrolling as an affiliate of Aqua Health Products Inc., you agree to comply with the terms and conditions outlined in this agreement.<\/p><p>This Agreement sets forth the complete terms and conditions of your participation in the Aqua Health Products Affiliate Program. The purpose of the program is to enable approved affiliates to promote Aqua Health Products via HTML links and marketing materials and to earn referral commissions through qualified purchases made via your affiliate links.<br \/>Throughout this Agreement, \u201cwe,\u201d \u201cus,\u201d and \u201cour\u201d refer to Aqua Health Products Inc., and \u201cyou,\u201d \u201cyour,\u201d and \u201cyours\u201d refer to the affiliate.<\/p><h3>2. Affiliate Obligations<\/h3><p>2.1 To apply, complete the online application at <a href=\"https:\/\/stage6.fayyazfreelancer.com\/affiliate-registration-portal\/\">https:\/\/stage6.fayyazfreelancer.com\/affiliate-registration-portal\/<\/a>. Applications are manually reviewed, and we reserve the right to accept or reject any applicant at our sole discretion, without obligation to provide justification.<\/p><p>2.2 Each affiliate is permitted one account only. Self-referrals and purchases made using your own affiliate links are strictly prohibited.<\/p><p>2.3 Affiliates may not replicate, imitate, or design websites that closely resemble any of our websites, including but not limited to aquahealthproducts.com, produitsaquasante.com, mayu.ca, aquaberkeyfilters.ca. This includes, among others, using domain names that are misspellings or variations of our brand, which could mislead customers.<\/p><p>2.4 Once accepted, you will have access to your affiliate dashboard at <a href=\"https:\/\/stage6.fayyazfreelancer.com\/affiliate-dashboard\/\">https:\/\/stage6.fayyazfreelancer.com\/affiliate-dashboard\/<\/a>, where you can find your unique affiliate link, banners, tracking tools, and coupon codes.<\/p><p>2.5 To accurately track visits and purchases, you must use your unique affiliate link or the HTML code provided. You must ensure that all affiliate links are properly formatted with your unique ID. It is your responsibility to verify the correct implementation of links on your site, social channels, emails, or other marketing platforms.\u00a0<\/p><p>2.6 Affiliates are solely responsible for ensuring their content complies with all applicable intellectual property laws on their website, social media channels, emails, &#8230; and any channel they choose to share their content. You must have the rights and express permission to use any and all content you publish, including any person&rsquo;s copyrighted material, whether it be a written piece, an image, or any other copyrightable work. We will not be responsible (and you will be solely responsible) if you use another person&rsquo;s copyrighted material or other intellectual property in violation of the law or any third party rights.<\/p><p>2.7 Affiliates may not post offensive, defamatory, illegal, or misleading content. We reserve the right to remove any affiliate found to be promoting harmful, inappropriate material, or material that does not align with our values.<\/p><p>2.8 Sharing any content about our products and websites that is not included in the Affiliates&rsquo; library should be previously approved by us.<\/p><p>2.9 You must maintain a valid Canadian physical address to participate in the program. If you relocate outside of Canada, your affiliate account may be terminated.<\/p><h3>3. Our Rights and Responsibilities<\/h3><p>3.1 We reserve the right to review and monitor your affiliate channels to ensure compliance. We may request changes to your materials or practices. Non-compliance may lead to termination.<\/p><p>3.2 Fraudulent or abusive practices, including misrepresentation, spam marketing, or self-referrals will result in immediate termination of your account without prior notice and forfeiture of all unpaid commissions.<\/p><h3>4. Modifications to the Agreement<\/h3><p>We may revise these terms at any time. Updates will be communicated via email. Continued participation in the program implies acceptance of the revised terms.<\/p><h3>5. Term of the Agreement<\/h3><p>This Agreement shall begin from the time of our acceptance of your affiliate application and shall end when terminated by either party. Either party may terminate this Agreement at any time, with or without cause, by giving the other party written notice of termination. If the Agreement is terminated by an affiliate in good standing, commissions will be paid out for sales generated by your affiliate link, up until the date of termination notification, even if the balance owed is less than CAD $50. Affiliates found in non-compliance with the membership and affiliate Terms &amp; Conditions will be immediately terminated without notice. If the termination is due to non-compliance with the terms and conditions set out herewith, no outstanding commissions will be paid out to the affiliate. Upon the termination of this Agreement for any reason, you agree to immediately cease use of, and remove from your site all graphics, banners, logos, and all other marketing materials provided by or on behalf of us to you in connection with the Aqua Health Products Affiliate Program.<\/p><h3>6. Payment of Commissions<\/h3><p>Commissions are calculated as a percentage of gross sales (excluding tax and shipping) made via your referral link.<\/p><p>Minimum payout is CAD $50.<\/p><p>We use AffiliateWP as our affiliate tracking software. This program allows us to determine the commissions earned for each affiliate. <br \/>Commissions are paid to affiliates as a percentage of the value of products sold to a lead that you referred to us through your personal affiliate link. The percentage may vary. Commissions are paid on gross sales, including discounts but excluding tax and shipping where applicable. Commissions are paid within 30 days for the prior month after your request if the sum of commissions exceeds the minimum transfer amount of CAD $50. We reserve the right to modify or amend the commission structure for any reason and at any time. Notifications of such changes, should they occur, will be sent to affiliates by e-mail. Your continued link to your affiliate site will be considered as acceptance of these changes. Money credited to Your Account does not accrue interest. In the event of a void order, we may recover from you the corresponding commission previously credited to your account. The void commission will be immediately deducted from your account balance. In the event that your account balance is less than the void commission, the void commission will be deducted against your future earnings.<\/p><h3>7. Promotion Restrictions<\/h3><p>Certain forms of advertising are strictly prohibited. For example:<\/p><ul><li>Any sort of spamming, including unsolicited commercial email<\/li><li>Posting on non-commercial newsgroups and cross-posting to multiple newsgroups at once.<\/li><li>Concealing or misrepresenting your identity, your domain name, or your return email address. You may use mailings to customers to promote our products as long as the recipient is already a customer or subscriber of your services or web site, and recipients have the option to remove themselves from future mailings.<\/li><\/ul><p>Also, when you post to news groups that welcome commercial messages, you must clearly represent yourself and your web sites as independent from any Aqua Health Products website or associated brand. If it comes to our attention that you are spamming, we will consider that cause for immediate termination of this agreement and your participation in the Affiliate Program and any pending balances owed to you will not be paid.<\/p><h3>8. Disclaimer<\/h3><p>Aqua Health Products makes no guarantees regarding uninterrupted website operation or error-free performance. We will not be liable for any damages resulting from system interruptions or technical issues.<\/p><h3>9. Confidentiality<\/h3><p>All confidential information shared during the term of this agreement\u2014including but not limited to business strategies, financial data, or customer details\u2014must remain confidential and not be disclosed without written consent.<\/p><h3>10. Miscellaneous<\/h3><p>10.1 You agree that you are an independent contractor, and nothing in this Agreement will create any partnership, joint venture, agency, franchise, sales representative, or employment relationship between you and Aqua Health Products Inc. You will have no authority to make or accept any offers or representations on our behalf.
